Defendant to give victim €1,000

A Ballyjamesduff man who assaulted another man in the town was ordered to pay his victim €1,000 in compensation when he pleaded guilty to assault at Virginia District Court.

Karl Farrelly, 8 Cusack Estate, Ballyjamesduff, was charged with assault Nicholas Fox at Market Street, Ballyjamesduff, on August 29.

Superintendent Colm Featherstone said the injured party called into the station in Ballyjamesduff and claimed he had been assaulted by the defendant. He stated that he had received a box in the face. Later when the defendant was interviewed he admitted the assault.

The defendant had one previous conviction for assault.

Judge Sean MacBride said that he would adjourn the matter until March 2 to enable the defendant pay the victim €1,000. "I'm all in favour of victims being compensated as a result of an assault." If the money was paid, the judge said he would giventhe defendant the benefit of the Probation Act but if he didn't he would be going away.

Community Service Order

Darren Mullen, 4 John Paul Avenue, Cavan, who has 47 previous convictions was ordered to complete 150 hours of community service in lieu of three months at a sitting at Virginia District Court. He was charged that on August 8 at the Lakeside Manor Hotel, Burrenrea, Virginia he used or engaged in threatening, abusive or insulting behaviour.

Addressing the defendant, Judge Sean MacBride said on two previous occasions he was served with community service orders and these had to be revoked. "If you don't carry out the 150 hours you will do three months." Judge MacBride noted that the defendant had a drug problem in the past.

"If the probation officer comes back to my court and tells me that you are dabbling in drugs or failing to turn up for work on any day, you are going down for three months."

The defendant said he was willing to do the work.

Warrants to issue

A bench warrant was issued at Virginia District Court for Keith Byrne, 85 Macroom Road, Coolock, Dublin, when he failed to appear on public order offences at Granard Street, Ballyjamesduff, on January 20.

A warrant was also issued for Stephen Perdisatt, Dufflands, The Commons, Navan, when he failed to appear at Virginia District Court on a charge of driving with excess alcohol at Rantavan, Mullagh, on May 25.

Brothers involved in a row

Two Bailieboro brothers who were involved in a row were each ordered to donate €250 to St. Vincent de Paul when they pleaded guilty to a public order offence at Virginia District Court.

Daryl and Mark Long both of 31 Heatherfield, Reekeevan, Bailieboro, were charged with being intoxicated at Main Street, Bailieboro, on January 16, and they have until March 2 to pay the money. Superintendent Colm Featherstone said gardai saw both defendants involved in a row.

Dangerous driving

Elaine Nolan, Grangelyon, Killeter, Mullagh, was directed to donate €500 to St. Vincent de Paul when she pleaded guilty at Virginia District Court to a dangerous driving charge at Billis, Ballyjamesduff, on July 25.

Superintendent Colm Featherstone said the defendant overtook a car on the N3 but met on coming traffic. She ended up on the hard shoulder. There was no collision and no one was injured. An off-duty sergeant observed the incident.

Donation to SVP

John Briscoe, 4 Dunsoughly Park, Rathoath Road, Finglas, Dublin 11, and Gerard Mooney, 7 Tanderagee, Bailieboro, were ordered to donate €250 each to St. Vincent de Paul for using or engaging in threatening, abusive or insulting behaviour at Main Street, Bailieboro, on January 16.

Superintendent Colm Featherstone said the defendants were involved in a row with other males on the Main Street.

No motor insurance

Brian Courtney, 23 Royal Canal Bank, Phibsboro, Dublin 7, was fined €500 and disqualified from driving for a year at Virginia District Court for having no insurance on his vehicle at Rahardrum, Virginia, on June 24. He was also fined €150 for having no drivers licence on the same occasion.
