Cavan nanny case put back to october

Cavan nanny Aisling Brady McCarthy will remain under house arrest in the US for the next six months at least after the date of her murder trial was put back yet again, this time until October 13.

Lavey-native Ms Brady McCarthy, who was released on bail for the first time since her arrest in connection with the death of one-year-old Rehma Sabir at the toddler's home in January 2013, was expected to stand trial in July of this year, but for all medical evidence in the trial to be re-examined.

At a hearing at Middlesex County Superior Court in Woburn, Massachusetts yesterday (Tuesday, May 20), Judge Maureen B Hogan set the trial commencement date for Tuesday October 13, but said that too was subject to change.

Representatives of the State medical examiner’s office were not present, but Judge Hogan asked that the office furnish details of its fresh review of evidence at the next scheduled pre-trial hearing in June.

Assistant District Attorney General Patrick Fitzgerald stated the prosecution’s case would consist of at least 50 witnesses, would take between four and six weeks and would begin each day at 9am and conclude by lunchtime.

Defence Counsel for Ms Brady McCarthy, attorney Melinda Thompson said she intended to call nine medical experts from around the world who would provide evidence baby Rehma was not in fact murdered, and had suffered serious injuries at a time when she was not in Ms Brady McCarthy’s care.

However, Ms Thompson stated that due to scheduling conflicts and summer holidays, some would not be available until the Autumn.

Under bail conditions set by the court earlier this month, Ms McCarthy must remain under house arrest at all times and wear a GPS tracking device.

She was also forced to give her passport to US authorities.
