Man released and file sent to DPP on hit-and-run

Mr Nulty (57) died three weeks ago, Thursday night, August 18.

The man arrested in connection with the investigation into the fatal hit and run that claimed the life of local man Frank Nulty has been released without charge.

A file will now be sent to the Director of Public Prosecutions on the matter.

Mr Nulty (57) died having suffered significant injuries when struck by a passing vehicle three weeks ago, Thursday night, August 18.

On Tuesday this week, September 6, gardaí arrested a 38-year-old male aged at Dublin Airport, who was then brought to Bailieborough Garda Station and detained for questioning in relation to the N3 hit-and-run pursuant to the provisions of Section 4 of the Criminal Justice Act, 1984.

They also announced that investigating officers had located the vehicle suspected of being involved in the collision. The vehicle has been seized, and a technically examination “has been completed”.

The Mazda 6, registration 151-G-6239, manufacturer identified ‘Deep Crystal Blue’ in colour, was considered essential in terms of evidential value.

Gardaí say the vehicle had sustained damage to the left front headlight, front bumper, left front passenger wing, and windscreen. It also has a missing wing mirror on the passenger side.

The male arrested was released earlier this morning, and a spokesperson for An Garda Siochana confirmed: “A file will be forwarded to the DPP.”

Where Mr Nulty was struck, at Billis Bridge, is just minutes from the deceased's home at Drumformina, New Inns, Ballyjamesduff.

He had, minutes earlier, alighted a bus from Virginia Town which dropped him off on the northbound side of the road, travelling in the direction of Cavan, at around 10pm on August 18.

Mr Nulty was pronounced dead by emergency services personnel at the scene.

A post-mortem was conducted at Cavan General Hospital, the results of which gardaí have not released for “operational reasons”.

Forensic Collision Investigators determined he had been struck by a vehicle, which subsequently failed to remain at the scene.
