Tractor case confirmed

Robert Russell, Miltown, Kilmainhamwood, Kells, who was awarded a decree for €1,816 in the district court arising from a civil claim had the decision affirmed in Cavan Circuit Court. He had taken the action against Peter Hanratty, Carrickleck, Kingscourt, for work done on a Massey Ferguson 3650. The case came before Bailieboro District Court in October 2007 when Mr. Russell was successful but Mr. Hanratty appealed the decision to the Circuit Court and Judge Donagh McDonagh affirmed the lower court decision with costs. The respondent claimed that he carried out work on the tractor and bill came to more than €3,000. Mr. Hanratty paid €2,000 of the bill but refused to pay the balance. Mr. Hanratty stated that he had been asked to pay €1,100 initially but Mr. Russell carried out more work than was necessary on the tractor. He did not feel he should pay for work he didn"t want.
