Teenager sentenced to eight months
Kevin Kelly (19), 21 Killymooney Drive, was sentenced to four months for assaulting Joseph Aspey at Tullacmongan Resource Centre, Tullacmongan Upper, on June 13, 2007. He was given an eight month concurrent sentence for assaulting James Connell at 101 Drumnaveil, Cootehill, on November 16, 2007, while a charge of causing €100 damage to a curtain rail the property of Margaret Kelly was taken into account. The defendant was given a two month current sentence for using or engaging in threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace at the Courthouse, Farnham Street, on December 13, 2007. Kelly was given a further six months concurrent for assaulting Andrew Boylan at Main Street, Cavan, on December 28, 2007. He was also given a six month concurrent sentence for failing to appear on bail at Cavan District Court on September 29, 2008. The defendant was also given a two month concurrent sentence for using or engaging in threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace at Church Street, Cavan, on December 26, 2008. Inspector R. McMahon said in relation to the incident at Drumnaveil, the injured party was in a house with a female, the accused and another male. A row developed between the injured party and the other two men and he was hit around the head with a brush. The injured party received a fractured nose as well as bruising around the head. A curtain rail was also damaged. The other individual involved in the attack received a six month sentence. With regard to the Joseph Aspey, Inspector McMahon said he was in the resource centre with his friends. He went outside for a cigarette and the accused and another individual invited him to fight. Mr. Aspey refused but he was assaulted and he fell to the ground. The co-accused received six months detention. Garda Conlon was on duty when he was approached by Andrew Boylan who claimed he had been assaulted by Kelly. Mr. Boylan claimed he was leaving his place of work when he was attacked by the defendant. A stone was also thrown at his car. The injured party was a young man who worked as a delivery man for a Chinese Takeaway. In relation to the incident at the courthouse on December 13, 2007, Mr. Aspey was giving evidence and later the defendant threatened to 'kill him' and 'cut his throat'. Mr. D. Rudden solicitor defending said his client"s father died when he was two years old and he didn"t have a parental influence when he was growing up. He left school when he was aged 15. His two older brothers became involved in crime and drugs and he did like wise. Mr. Kelly had a problem with drugs and alcohol. At the time of the incident, he was on a high from a cocktails of drugs and alcohol. He claimed it was Mr. Aspey who was the aggressor and started the fight and he denied that he spoke to Mr. Aspey at the courthouse. Mr. Kelly fled Cavan town as he wanted to get away from the whole scene he was involved with. Mr. Rudden had informed his client that he was looking at a custodial sentence. Mr. Kelly would be seeking counselling for drug and alcohol addictions. It was a Jekyll and Hyde situation when he had drugs and alcohol taken. Judge Sean MacBride said the defendant had pleaded guilty to serious offences. 'Your life is based on violence meshed in drugs and alcohol. However, I have to protect society and I have no option but to impose a custodial sentence.' Judge MacBride recommended that the defendant receive treatment for drugs and alcohol abuse. Recognisances were fixed in the events of an appeal.
