Jailed for pub assault

Cavan District Court.
Charles McDonagh, 10 Townparks, Cavan was jailed for nine months when convicted of assaulting Garda Gary Brennan at Tullymongan Upper on March 24, 2009. He was given a concurrent nine-month sentence for obstructing Garda Aveline Duffy on the same occasion.
Inspector Alan Cunningham told the court that when the gardaí arrived at the scene Charles McDonagh was struggling violently and started to kick and headbutt the gardaí who were trying to handcuff him.
He caused Gda Brennan to have a nosebleed and the gardaí were put to the pin of their collar to get the defendant subdued. When they were putting him in the car, he kicked out violently and continued to struggle while in the patrol car.
Insp. Cunningham added that he also made derogatory comments about the garda's mother in a sexual context, which was absolutely disgraceful.
Judge MacBride said it was a "horrific" and "extremely violent" assault on a garda, while effecting a lawful arrest.
The defendant pleaded guilty. Recognisances were fixed in the event of an appeal.
