Returned for trial on drugs rap

A Dublin man was returned for trial to the next sitting of Cavan Circuit Court on March 8 when he appeared at Cavan District Court charged with possessing cannabis valued €13,000. Kenneth Donnelly, 8E Pearse House, Dublin 2, was charged with offence at Pollamore Far, Cavan, on March 28, 2009. He was also charged with cultivating the plant, having it for sale or supply and possessing it.

Garda Bernard Smith said they were objecting to bail and were seeking a remand in custody as the defendant refused to give an address and said he had no fixed abode. The address in Dublin belonged to his mother and she claimed that he had not lived there for seven or eight years.

Garda Smith arrested the defendant in Blanchardstown where he was signing on. The defendant still refused to give his name and address.

He was in custody since February 2, 2010.

In evidence, Donnelly said that he would live at his mother's address if he was given bail. He had not spoken to her about it but he would if given a chance.

Judge Conal Gibbons said he was refusing the bail application as the defendant had no permanent address.

Returned for trial

Ahmed Hussain, Carrickane, Cavan, was also returned for trial to the same Circuit Court for failing to keep full and true records of all income tax records for the period October 1, 1999 to December 31, 2006. He was also summoned for failing to make tax returns for the years 2001 to 2006 inclusive.

Brian Convey, 21 Park Lawn, Tubbercurry, Sligo, was returned for trial to the same Circuit Court charged that on August 13, 2008, at Killydoon, Loughduff, he possessed a stolen John Deere tractor, valued €80,000.

Remanded in custody

A 35-year-old Armagh man was remanded in custody to Castleblayney District Court sitting in Carrickmacross when he appeared at Cavan District Court on motoring offences.

Brian Finnegan, 66 Concession Road, Crossmaglen, was charged with dangerous driving at Drumleek South, Castleblayney, on February 11, 2010. He was also charged with driving a defective lorry.

Garda John Doherty said gardaí saw the defendant jump out of a 40-foot artic lorry, which they believe contained 13,000 litres of washed fuel. Initially gardaí on patrol tried to stop him but couldn't.

They followed the lorry and they ended up in a farmyard. The defendant jumped out and tried to evade capture.

Cross-examined by Damien Rudden, solicitor defending, Gda Doherty said he was not present when the defendant was arrested. He saw the vehicle at Castleblayney Garda Station. During interview, the defendant admitted he tried to abscond from the gardaí.

In evidence, the defendant said if he was given bail, he would turn up for trial. He owned a house in Cortail, Dundalk and he was employed as a lorry driver.

Replying to inspector Alan Cunningham, Mr. Finnegan admitted he tried to get away as he knew the lorry was not roadworthy. He was two years living at his current address and had lived in Dundalk before that.

Judge Conal Gibbons said he was refusing bail and was remanding the defendant in custody.

Due Care

Patrick Kiernan (19), Leitrim, Bailieboro, was ordered to donate €250 to the Tullacmongan Resource Centre at Cavan District Court for driving without due care and attention at Townparks, Cavan, on September 25, 2009.
