DPP given final chance to produce book of evidence
The Director of Public Prosecutions (DPP) has been given one final chance to produce the book of evidence against two Cavan men who are before the local district court on a host of charges.
Charles McDonagh, 64 Lakeview, Fairgreen, Cavan and Terence McDonagh, 10 Townparks, Cavan, have been on remanded for a number of charges including escaping from Loughan House, Blacklion on April 15. They were also charged with failing to stop for a garda at Rahellistin, Redhills, on April 16, causing criminal damage and endangerment.
They were also charged with burglary at Packie Willies, the Diamond, Clones and criminal damage. Charles McDonagh was charged with allowing himself to be carried in a vehicle knowing it to have been stolen at Toam, Blacklion, and Townparks, Cavan town, on the same date.
The defendants were further charged that at Drumbo and Drumalee, they failed to stop for a garda and causing criminal damage. They were also charged with obstructing a garda at Castlesaunderson Demesne, Redhills, and using or engaging in threatening behaviour. At Cloverhill and Drumcrow, Butlersbridge, they were charged with endangerment.
They were charged with trespass at Leggykelly, Redhills and burglary at Mischief, Main Street, Arva.
Terence McDonagh was also charged with drink driving, two counts of dangerous driving, failing to give information to a garda, the unlawful taking of a car, driving through a red light and allowing himself to be carried in a vehicle knowing it to have been stolen.
When the case came before the Cavan court, John McCoy BL (instructed by John Gaffney solicitor) said the case had been adjourned on June 18 peremptory against the state. "There is no excuse for the book not to be ready as they are not difficult charges."
Judge Sean MacBride agreed that they appeared straight forward.
Inspector Seamus Boyle pointed out that there were over 50 charges against the defendants in the book and some of the offences occurred in Clones.
Judge MacBride stated he would give one final adjournment until tomorrow (Thursday) July 29 and if the book was not prepared, he would strike the matter out.
Addressing the inspector, the judge advised him to get in touch with the DPP.
